Terms of Service for Operators
Last updated: 17 October 2026
These terms govern the relationship between Grup Bages Formadors SL (tax ID B61690723, registered office at C/ Dupont 34, 08262 Callús (Barcelona, Spain)), owner of the For Holidays platform ("For Holidays", "we", "us"), and the business or professional that signs up to publish and sell activities through it (the "Operator" or "you"). By creating an account, requesting your booking page or publishing an activity you accept these terms, the Data Processing Addendum and the Privacy Policy.
For Holidays provides services to professionals. It is not a consumer service, and the Operator declares that it acts in the course of its business or profession.
1. What For Holidays is and our role
For Holidays is an online booking platform that lets the Operator publish activities, manage availability and capacity, receive bookings from travellers and collect payment electronically. We act as a technology and payment-collection intermediary: we provide the tool, display the Operator's offer and handle payment on the Operator's behalf.
The contract for the activity is concluded directly between the traveller and the Operator. For Holidays is not the organiser, supplier or seller of the activities, is not a party to that contract and does not guarantee its performance. A single activity booked through the platform is not a package travel arrangement.
These terms do not create an employment, partnership, franchise or agency relationship between the parties beyond the collection mandate described in clause 7.
2. Sign-up, account and requirements
To operate you must be of legal age, have capacity to contract and be legally entitled to carry on the activity you publish. You must provide truthful and complete information (identity or company name, tax ID, address, contact details and a SEPA bank account) and keep it up to date.
You are responsible for keeping your credentials confidential and for all activity under your account. Tell us immediately about any unauthorised use.
We may verify your identity and business (including documents proving licences, insurance and tax registration) before or after activating your account, and ask for further information where applicable law requires it, in particular on anti-money-laundering and taxation.
3. Operator obligations
The Operator undertakes to:
- Deliver booked activities under the conditions, date, time and price published, with professional diligence.
- Hold and keep valid all licences, permits, registrations, professional qualifications and insurance (including public liability and, where applicable, accident cover) required by law for each activity.
- Comply with applicable safety, health, consumer-protection, data-protection, employment, tax and accessibility law, and with the safety requirements specific to each activity (minimum age, fitness, equipment).
- Publish accurate, clear and non-misleading information: description, duration, language, meeting point, what is and is not included, restrictions, cancellation policy and final price.
- Keep availability and capacity up to date and not sell through other channels places already sold through the platform.
- Set and publish a cancellation and refund policy for each activity before it can be booked (see clause 8) and honour it.
- Respond promptly to travellers, handle their complaints and respect their consumer rights.
- Issue the traveller with the invoice or receipt due for the activity and comply with your tax and social-security obligations.
- Not publish unlawful, misleading or discriminatory content or content infringing third-party rights, and not use the platform for activities prohibited by law.
4. Operator content
You keep ownership of the texts, photographs, logos and other content you publish. You grant us a free, non-exclusive, worldwide licence, for as long as your account is active, to host, reproduce, adapt to the platform's format and display it on your booking page, in the widget and in our channels promoting the platform.
You warrant that you have sufficient rights in that content and will hold us harmless against third-party claims arising from it.
5. Contract with the traveller and prices
You set the price of each activity. Published prices must be final for the traveller, i.e. include applicable taxes (VAT or others) and any mandatory charge on your side.
A booking is confirmed when payment is completed and the traveller receives the confirmation email. From then on you must deliver the activity or, if you cannot, cancel it and refund the traveller under clause 8.
You accept that, before paying, the traveller will see and accept the Traveller Terms, the platform's cancellation and refund policy and the policy you have set for the activity.
6. For Holidays commission
There is no sign-up fee or monthly fee. For each booking paid through the platform, For Holidays charges a booking fee of 6% of the activity amount (after discounts and promo codes), with a minimum of EUR 2.50 per booking.
This fee is shown to the traveller as a separate line ("Booking fee") that is added to the activity price. The Operator receives 100% of the activity price collected (after any discounts the Operator itself applied), with no deduction for the booking fee, except for refunds, chargebacks and set-offs provided for in these terms.
Payment-processing costs (Stripe) are borne by [COMPLETAR: confirm who bears Stripe fees: For Holidays out of the booking fee, or the Operator].
Invoicing of the booking fee and VAT: [COMPLETAR: state to whom the booking fee is invoiced (traveller or Operator), with what VAT treatment and within what period].
We may change the fee with at least 30 days' notice by email or in the dashboard. The change will not affect bookings already made. If you disagree you may close your account before it takes effect.
7. Collection on the Operator's behalf and payouts
The Operator instructs us to collect, in its name and on its behalf, the price of the activities booked. Travellers' payments are received through Stripe in For Holidays' account. The traveller's payment discharges their payment obligation to the Operator for the amount collected.
For Holidays pays out to the Operator once a month, by SEPA bank transfer to the account you have provided, the amount of activities collected and not refunded, within the first 15 calendar days of the month following the month of the activity [COMPLETAR: confirm exact payout deadline]. With each payout we provide a statement of bookings, amounts collected, booking fee, refunds and adjustments.
We may withhold or set off amounts from a payout where there are pending refunds, chargebacks, open disputes, reasonable suspicion of fraud, or requests from authorities or the payment institution. We will tell you the reason.
You are responsible for giving us a valid IBAN in your name. We are not liable for delays or returned payments caused by incorrect bank details.
8. Cancellations, refunds and chargebacks
By default, the Operator sets the cancellation and refund policy for each activity and it is shown to the traveller before payment. If you do not set one, the default policy on the cancellation page applies.
- Cancellation by the Operator (including for weather, safety, minimum group size not met or any other cause on your side): the traveller is entitled to a full refund, including the booking fee, or to reschedule if they agree. The amount is deducted from your payout.
- Cancellation by the traveller: governed by the policy you have published. Amounts retained under that policy are paid out to you; the rest is refunded to the traveller.
- Right of withdrawal: under article 103(l) of Spanish Royal Legislative Decree 1/2007, contracts for leisure activities with a specific date or period of performance carry no right of withdrawal unless you offer one. You must tell the traveller.
- Chargebacks and payment disputes: if a traveller disputes a charge with their bank and the dispute is decided against us, the amount, together with dispute fees charged by the payment institution, will be deducted from your payout or claimed from you, unless the cause is attributable to For Holidays. We will help you provide documentation to defend the booking.
- Refunds are made to the payment method the traveller used. The booking fee (6%, minimum EUR 2.50) is refunded in full when the traveller cancels within the free-cancellation window; in the partial-refund window (if the Operator sets one) and after the deadline it is not refunded.
9. Taxes
Each party is responsible for its own tax obligations. The Operator alone is responsible for taxes arising from delivering its activities and from the income it receives, and for issuing invoices to the traveller.
We may request your tax ID, EU VAT number or other tax details and, where the law requires, report income earned through the platform to the competent authorities.
10. Data protection
For travellers' data you receive through the platform, you are the controller for the purpose of delivering the activity, and For Holidays acts as processor when it hosts and manages those bookings on your behalf, under the Data Processing Addendum, which forms part of these terms. For its own purposes (payment handling, fraud prevention, invoicing, security and improving the platform) For Holidays acts as an independent controller, as explained in the Privacy Policy.
You must use travellers' data only to deliver the activity and meet your legal obligations, and not for marketing without an appropriate legal basis.
11. Platform intellectual property
The software, design, trademarks, texts and other elements of For Holidays belong to Grup Bages Formadors SL or its licensors. These terms only give you a personal, revocable, non-exclusive, non-transferable right to use the platform while your account is active.
12. Service availability and liability
We make reasonable efforts to keep the platform available and secure, but do not guarantee uninterrupted or error-free operation. We may carry out maintenance or improvements that temporarily limit access.
For Holidays is not liable for the delivery, quality or safety of activities or for damage arising from them, which are the Operator's sole responsibility. The Operator shall hold For Holidays harmless against claims by travellers or third parties arising from the activities or from its breach of these terms or the law.
To the extent permitted by law, For Holidays' total liability to the Operator for any cause is limited to the booking fees actually received by For Holidays for the Operator's bookings in the 12 months before the event giving rise to the claim, and excludes loss of profit and indirect damage. This limitation does not apply to wilful misconduct or gross negligence or to any liability that cannot be limited by law.
13. Term, suspension and termination
The agreement is for an indefinite term. You may close your account at any time by writing to hola@forholidays.app, without penalty, subject to bookings already confirmed, which you must deliver or cancel and refund under clause 8. We will settle outstanding amounts in the next monthly payout.
We may suspend or terminate your account with immediate effect and without notice for serious or repeated breach of these terms, false information, reasonable suspicion of fraud, risk to travellers' safety, breach of law or a request from an authority. In other cases we will give 30 days' notice. On termination, confirmed bookings follow the procedure in clause 8.
14. Changes to the terms
We may update these terms. We will notify you by email or in the dashboard at least 30 days before substantial changes. If you keep using the platform after that date you are deemed to accept them; if you disagree you may close your account beforehand.
15. Governing law, jurisdiction and contact
These terms are governed by Spanish law. The parties submit to the courts of [COMPLETAR: confirm venue, e.g. Manresa], waiving any other venue that might apply, without prejudice to mandatory rules.
