Website creation and care service contract

1. Purpose

For Holidays designs, builds, publishes and, if the Client takes a care plan, hosts and maintains the Client's website according to the pack and plan chosen in the order.

2. Creation packs (one-off)

• One page: €99. 1 page, 1 language, mobile-friendly, button to the booking link, 1 round of changes.
• Business: €299. Up to 5 pages, 1 language, bookings and online payment built in, basic local SEO (titles, descriptions, sitemap), contact form and WhatsApp, 2 rounds of changes.
• Premium: €599. Up to 10 pages, up to 3 languages, blog, gift voucher shop, Google Business profile set up, bookings and online payment built in, 3 rounds of changes and priority support.

A "round of changes" is a single list of corrections the Client sends on the draft. Extra rounds, pages or features not included in the pack are quoted separately.

3. Included in the pack

Every pack includes, at no extra cost, registering the domain for the first year (or connecting a domain the Client already has) and configuring hosting, the SSL certificate and email forwarding, plus the first month of the chosen care plan (30 days from the order). Domains with an unusually high registration price (some special extensions) are quoted before registering them.

Where the registry allows it, the domain is registered in the Client's name and the Client owns it.

4. Extras

Extras the Client ticks in the order (more languages or pages, copywriting, custom design, photos, logo, content migration, voucher shop or others) are not included in the pack price. We send a written quote and we never do or charge for an extra without the Client's express acceptance.

5. Timing and the Client's input

We deliver a first clickable draft within 24 hours, counting weekdays only, of receiving all the Client's material (text, photos, logo, activity details). If the material arrives late or incomplete, the time counts from when it is complete.

The Client warrants that they hold the rights to the text, images, trademarks and other content they give us, and that it is truthful and lawful. We may refuse unlawful content or content that infringes third-party rights.

If the Client sends no material and does not reply for 60 days after the order, we may treat the project as delivered with the material available; the pack already paid is not refunded, except as set out in clause 9.

6. Care plans (monthly)

• Basic: €7.99 a month. Hosting, SSL certificate, yearly domain renewal, backups and technical and security updates. No content changes.
• Plus: €19.99 a month. Everything in Basic plus 1 small change a month, with a reply within 2 working days.

A "small change" means changing text, photos, prices, opening hours or an activity on an existing page, up to about 30 minutes of work. It is not carried over to the next month. New pages or sections, redesigns and other tasks are quoted separately.

The website is published on our hosting while the plan is active. Without an active plan we do not guarantee the website stays online (see clause 8).

7. Price and payment

Prices include VAT. The pack, which includes the domain, setup and the first month of care, is paid online when ordering. The care plan is charged from the second month, in advance every month and on the same date, to the payment method saved through Stripe, which issues a receipt for each charge.

If a monthly charge fails, we notify the Client by email. If it is still unpaid 15 days later, we may suspend the website until it is settled; after 60 days unpaid the contract ends.

We may change the plan prices with at least 30 days' notice; the Client can cancel before the change applies.

8. Term, cancellation and exit

No minimum term. The plan is monthly and renews automatically. The Client can cancel at any time from the link in the Stripe email or by writing to hola@forholidays.app; cancellation takes effect at the end of the month already paid and months already started are not refunded.

When the contract ends, and provided nothing is owed, we transfer the domain to the Client (authorisation code) and hand over a copy of the website files and content within 15 days. The website stays online until the end of the paid month.

9. Cancelling the pack before work starts

If the Client cancels the order before we have started (before receiving their material or sending the first draft), we refund the pack and the setup, minus the cost of the domain if it has already been registered. Once the first draft has been delivered, the pack is non-refundable.

10. Ownership of the website

Content provided by the Client belongs to the Client. Once the pack is paid, the Client owns the design and text created for their website and receives a free, perpetual licence to use the generic For Holidays components, templates and code it contains, which we may keep using in other projects.

We may mention the Client's website as an example of our work (name and screenshot) unless the Client asks us in writing not to.

11. Online bookings and payments

The booking and online payment link built into the website is governed by the Operator terms of service, including the 6% commission per paid booking (minimum €2.50). The website service adds no fee for that link.

12. Availability and liability

We work to keep the website online as much as possible, but we do not guarantee uninterrupted service: there may be downtime for maintenance or failures of providers (hosting, domain registry, payments).

Our total liability to the Client under this contract is limited to the amounts paid in the 12 months before the event giving rise to it, and excludes loss of profit and indirect damage, except in cases of wilful misconduct or gross negligence.

13. Personal data

To build and host the website we process personal data on the Client's behalf (for example, contact form messages). That processing is governed by the Data processing agreement (DPA) published on this website, which forms part of this contract.

14. Governing law and jurisdiction

This contract is governed by Spanish law. For any dispute, the parties submit to the courts of [COMPLETAR: confirm venue, e.g. Manresa].

If this contract is offered in translation, the Spanish version prevails in case of any difference.
